Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to all access to and use of The Construction App (the "Solution"), whether by Customers, their employees, or permitted third-party contractors ("Collaborators"). This AUP is in addition to, and forms part of, the Terms & Conditions and the End-User Services Agreement. Capitalized terms not defined here have the meaning given to them in those agreements.
4.1 General Expectations
You agree to use the Solution lawfully, in good faith, for legitimate construction-industry business purposes, and in a manner that respects other users and third parties. You are responsible for all activity occurring under your account.
4.2 Prohibited Activities
You will not, and will not permit anyone using your account to:
- violate any applicable law or regulation, including occupational health and safety laws, electrical or building codes, privacy laws, intellectual-property laws, anti-spam laws, and export-control laws;
- upload, post, or transmit content that is unlawful, defamatory, harassing, abusive, threatening, hateful, sexually explicit, or that incites violence or discrimination against any person or group;
- falsify, omit, or backdate information in time entries, daily logs, inspections, safety reports, sign-offs, photos, or other records, in a way that misrepresents what occurred on a project;
- misrepresent your identity or affiliation, impersonate any person or entity, or attribute statements or actions to a person or company that they did not make or take;
- share account credentials, log in from a device you are not authorized to use, or use an account that was not directly created for you;
- use the Solution to send unsolicited promotional or commercial messages ("spam"), chain letters, pyramid schemes, or similar communications;
- upload or distribute viruses, worms, malware, or any other code intended to disrupt, damage, or gain unauthorized access to the Solution, our infrastructure, or any third-party system;
- attempt to probe, scan, or test the vulnerability of the Solution, breach security or authentication measures, or interfere with service to any user, host, or network;
- reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying ideas, or algorithms of the Solution;
- use scrapers, robots, spiders, or other automated tools to access the Solution or extract data, except for authorized API access in accordance with our documentation;
- resell, rent, sublicense, or otherwise commercially exploit the Solution or any data obtained from it without our prior written consent;
- use the Solution in a service-bureau or outsourcing arrangement to provide services to third parties (other than to your own clients in your normal course of business as a construction-industry participant);
- upload Customer Data that you do not have the right to upload, or that infringes the intellectual-property, privacy, or other rights of a third party; or
- use the Solution in any manner that, in our reasonable judgment, could damage, disable, overburden, or impair the Solution or interfere with any other party's use of it.
4.3 Content You Submit
You retain ownership of the content you submit to the Solution, but you grant us a limited, worldwide, royalty-free licence to host, store, transmit, display, copy, and back up that content solely as needed to provide the Solution to you and your Customer. You are solely responsible for the legality and accuracy of the content you submit.
4.4 Reporting Violations
If you believe another user has violated this AUP — for example, by harassing you, posting unlawful content, or compromising security — please report it to feedback@theconstructionapp.ca. We will review reports in good faith and take action we consider appropriate, which may include warning the user, removing content, or suspending or terminating accounts.
4.5 Enforcement
We reserve the right, at our discretion, to investigate any suspected violation of this AUP. We may suspend or terminate access to the Solution (in whole or in part), remove offending content, and/or report conduct to law enforcement, in each case as we consider reasonable in the circumstances. Where the violation is committed by an end-user under a Customer account, we may also notify the Customer and require the Customer to take corrective action.
4.6 Changes
We may update this AUP from time to time as our services and the legal landscape evolve. The current version of this AUP will always be available within the Solution. Continued use of the Solution after a change to this AUP constitutes acceptance of the updated AUP.
