Privacy Policy

3.1 General Principles
The Construction App Inc. ("we," "us," "our") has prepared this Privacy Policy to describe how we collect, use, disclose, and safeguard personal information in connection with The Construction App (the "Solution"), our web application at theconstructionapp.app, our public website at theconstructionapp.ca, and any associated mobile or web applications. This Privacy Policy applies to information that we process as a service provider on behalf of our customers and to information we process for our own business purposes (for example, account registration and billing).
Personal information collected through the Solution may be stored or processed on servers located in Canada and the United States, and may be subject to the laws of those jurisdictions. By using the Solution, you consent to such cross-border transfer and processing.

This Privacy Policy is effective as of June 29, 2026 and is incorporated into our Terms & Conditions and End-User Services Agreement.
3.2 Notification of Changes
If we change this Privacy Policy, we will post the updated version through the Solution and/or notify you by email. Changes are effective when posted unless we indicate otherwise. If you do not agree to a change, please contact us; we will only use information collected from you in accordance with the version of this Privacy Policy that was in effect at the time of collection (subject to any required updates to comply with law).
This Privacy Policy does not apply to third-party websites or services linked from the Solution. Please review the privacy policies of those third parties before providing them with personal information.
3.3 What personal information do we collect?
3.3.1 Information you provide
We collect personal information you provide when you (or your employer) register with us or use the Solution, including:
- name, job title, and the company you are associated with;
- contact details such as email address, phone number, and work address;
- information you input into the Solution about projects, sites, time entries, tasks, inspections, deficiencies, photos, drawings, comments, and other operational data;
- information about your role, certifications, trades, project history, and similar profile data, including any custom fields configured by your employer;
- billing details if you are responsible for payment, such as billing address and payment method (we do not directly store full payment-card numbers — see Section 3.6); and
- any other information you or your employer choose to enter into projects, forms, records, or other free-form fields. The Solution is a general-purpose construction-management tool and is not designed or intended to collect sensitive personal information (such as health information). You and your employer are responsible for the information you choose to input and for ensuring you have the right to provide it.
3.3.2 Information collected automatically
When you use the Solution, we automatically collect certain technical information, including:
- the URL and source from which you arrived;
- the pages, screens, and features you access;
- your browser type, app version, operating system, and device information;
- the dates, times, and durations of your sessions;
- technical identifiers such as IP address, time-zone setting, and approximate location based on IP address; and
- information about your interactions with the Solution (such as button presses, response times, and errors).
We may use standard technologies such as web beacons, cookies, and similar identifiers to collect this information and to measure the effectiveness of communications such as email newsletters.
3.3.3 Cookies and similar technologies
Cookies are small data files placed on your device that allow us to recognize you when you return to the Solution. We use cookies and similar technologies to keep you logged in, remember your preferences, secure your session, and understand how you use the Solution. You can change your device or browser settings to block cookies, but doing so may affect functionality.
3.3.4 Customer correspondence and surveys
If you contact us by email, chat, or phone, we retain a record of that correspondence so we can respond and improve our services. From time to time we may invite you to participate in optional surveys; participation is voluntary and the use of any responses will be explained in the survey itself.
3.3.5 Aggregated and de-identified data
We may generate aggregated, de-identified, or anonymized data from the information we process. This data does not identify you and is not considered personal information. We may use such data for any lawful business purpose, including improving the Solution, benchmarking, and analytics.
3.4 How we use the information we collect
We use personal information to:
- verify your identity and provide access to the Solution;
- set up, manage, and support your account;
- process transactions and bill for our services;
- operate, maintain, secure, and improve the Solution;
- provide customer support and respond to inquiries;
- perform research and analysis on usage of the Solution to develop new features and fix issues;
- communicate with you about your account, security, service updates, and other administrative matters (you generally cannot opt out of these messages while you have an active account);
- with your consent or as otherwise permitted by law, send you marketing communications about our products and services; you can opt out of marketing communications at any time;
- enforce our Terms & Conditions, EUSA, and Acceptable Use Policy;
- comply with applicable laws and regulatory requirements; and
- for any other purpose disclosed to you at the time of collection.
Where you enter information into free-form fields, forms, or records, you (and your employer) are responsible for that content and for ensuring its collection and use comply with applicable law. We process that information only as necessary to provide the Solution to you and your Customer.
3.5 Disclosure of personal information
We do not sell your personal information. We disclose personal information only as set out below or with your consent:
- To your Customer or employer organization. If you access the Solution through a Customer account, the Customer is the controller of the data you submit and may have access to it.
- To service providers. We share personal information with vendors that perform services on our behalf, such as cloud hosting, payment processing, email delivery, customer-support tooling, and analytics. These providers are bound by contract to use personal information only as needed to perform their services and to protect it appropriately.
- To comply with law. We may disclose personal information when we believe in good faith that it is required by law, regulation, court order, subpoena, or other legal process, including in response to law-enforcement requests.
- To enforce our rights. We may disclose personal information to enforce our agreements or to protect the rights, property, or safety of the Company, our customers, or others.
- In a corporate transaction. If we are involved in a merger, acquisition, financing, or sale of all or substantially all of our assets, personal information may be transferred as part of that transaction, subject to standard confidentiality protections.
3.6 Information security
We are committed to protecting personal information using a reasonable combination of administrative, physical, and technical safeguards, including:
- limiting access to personal information to staff and contractors who need it to provide our services;
- encrypting personal information in transit using TLS/SSL and encrypting sensitive data at rest where reasonably practicable;
- not storing full payment-card numbers on our systems — payment information is processed by PCI-compliant third-party processors; and
- maintaining incident-response procedures so that, in the event of a security incident affecting personal information, we can investigate, mitigate, and notify affected individuals and authorities as required by law.
No security measure is perfect. You also play an important role: keep your password confidential, do not share your account, and notify us immediately if you suspect that your credentials have been compromised.
3.7 Retention and deletion
We retain personal information for as long as your account is active and as needed to provide the Solution. After your account is closed, we delete or anonymize personal information within a reasonable period, except where retention is required by law (for example, for tax or audit purposes), to resolve disputes, or to enforce our agreements. Backups may persist for a limited additional period before being overwritten.
You may request a copy of the personal information we hold about you, ask us to correct inaccuracies, or ask us to delete information, by contacting feedback@theconstructionapp.ca. Where you access the Solution through a Customer account, we may direct your request to that Customer.
3.8 Your rights
Depending on where you live, you may have rights under applicable privacy laws (such as Canada's Personal Information Protection and Electronic Documents Act and applicable provincial or territorial privacy laws) to access, correct, or delete your personal information, to withdraw consent, or to lodge a complaint with a privacy regulator. We will respond to verified requests within the timeframes required by applicable law.
3.9 Children
The Solution is intended for use by adults in a professional construction-industry context. We do not knowingly collect personal information from children. If you believe we have collected personal information from a child, please contact us so we can delete it.
